Harmer’s Town – Notice of Intent to Request Release of Funds Havre de GraceHarmer’s Town – Notice of Intent to Request Release of Funds NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS August 1, 2025 City of Havre de Grace 711 Pennington Avenue Havre de Grace, MD 21078 410-939-1800 On or about September 1, 2025 the City of Havre de Grace will authorize the Harmer’s Town Arts Center, Inc. to submit a request to the US Department of Housing and Urban Development (HUD) for the release of Community Project Funding under Title Consolidated Appropriations Act, 2024 (Public Law 118-42) and the Further Consolidated Appropriations Act, 2024 (Public Law 118-47) to undertake a project known as Harmer’s Town Arts Center for the purpose of full renovation and rehabilitation of an existing building having an approximate area of 39,800 sf. The building is located at 119 Market Street in Havre de Grace. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the City of Havre de Grace Department of Planning, 711 Pennington Avenue in Havre de Grace and may be examined or copied weekdays 9 A.M to 4 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Havre de Grace Department of Planning. All comments received by 8/8/2025 will be considered by the City of Havre de Grace prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The City of Havre de Grace certifies to HUD that Geoffrey Goins in his capacity as Director of Planning for the City of Havre de Grace consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Harmer’s Town Arts Center to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Havre de Grace’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Havre de Grace; (b) the City of Havre de Grace has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
